State v. Gaters

The Supreme Court affirmed the circuit court’s denial of Defendant’s motion to suppress evidence discovered after police officers executed a search warrant at Defendant’s home. During the search, officers found marijuana in Defendant’s van, which was parked outside the home. The circuit court ruled (1) Defendant did not have a personal, legitimate expectation of privacy in his friend’s home and therefore could not challenge the search; and (2) alternatively, the search did not violate Defendant’s Fourth Amendment rights. The Supreme Court affirmed, holding that the circuit court did not err when it denied Defendant’s motion to suppress because Defendant did not establish a protectable interest in the property searched.
