The Supreme Judicial Court affirmed Defendant’s conviction of murder in the first degree on a theory of extreme atrocity or cruelty. The court also denied Defendant’s motion for a reduced verdict and declined to grant extraordinary relief pursuant to Mass. Gen. Laws ch. 278, 33E. The court held (1) there was no error committed by trial counsel, the trial judge or the prosecutor that created a substantial likelihood of a miscarriage of justice; and (2) there was no reason to remand Defendant’s case to the superior court for renewed consideration of his motion to reduce the verdict or to grant him relief under Mass.
