United States v. Concepcion-Montijo

by
The First Circuit affirmed the district court’s judgment sentencing Defendant to a 120-month statutory maximum term of imprisonment in connection with his guilty plea to a single count of being a felon in possession of a firearm. The court held (1) the district court did not commit procedural error by focusing on Defendant’s numerically and graphically expansive record of drug and weapons charges to justify its variant sentence; and (2) the district court did not abuse its discretion in concluding that the statutory maximum sentence was justified because of Defendant’s pattern of serious crimes, and therefore, Defendant’s sentence was not substantively unreasonable.
