The First Circuit reversed the district court's denial of Appellant’s petition for a writ of habeas corpus challenging his convictions for armed assault with intent to murder and other offenses, holding that trial counsel’s failure to move to suppress Appellant’s statements to a police officer while in custody constituted ineffective assistance of counsel under clearly established law.In his petition for a writ of habeas corpus, Appellant argued, inter alia, that he was deprived of effective assistance of counsel because trial counsel failed to move to suppress his statements to the police officer. The district court denied the writ. The First Circuit reversed, holding that trial counsel’s deficient performance was sufficiently prejudicial to constitute a violation of Appellant’s Sixth Amendment right to counsel. View "Rivera v.
