The Fifth Circuit affirmed defendant's conviction for illegal reentry. The court held that defendant's possible misunderstanding of the consequences of testifying triggered no duty for the district court to explain the right to testify. The court also held that the district court properly denied defendant's motion to dismiss the indictment where the court's precedent foreclosed his argument that the district court should have dismissed his indictment based on defects in his removal proceedings.
