In an interlocutory appeal, the Colorado Supreme Court reviewed a district court order suppressing drug evidence that the defendant dropped on the ground when he was approached by the police on the street. The Supreme Court concluded the trial court erred in suppressing the evidence because, at the time the defendant dropped the drugs, no seizure had taken place.
