People v. Espinoza

Ident-A-Drug, an internet drug reference work, comes within the published compilation exception to the hearsay rule set forth in Evidence Code section 1340. The Court of Appeal affirmed defendant's conviction of possession of a controlled substance in a jail facility. In this case, a criminalist testified that Ident-A-Drug was used to presumptively identify the pills as controlled substances. The court noted that practical wisdom and common sense lead to the reasonable inference on appeal that defendant knew the drugs were real and that he acted with criminal intent when he brought the pills into the county jail. The court modified the judgment to reflect that three prior prison term enhancements were stricken at the sentencing hearing and affirmed the judgment as modified. View "People v.
