Augustine Garnica Perez Jr. appealed after he was convicted for felony DUI. He challenged the district court’s decision to deny his motion to suppress evidence gathered as a result of an investigatory stop. Specifically, he felt information provided by a citizen during a call to dispatch was insufficient to create the reasonable, articulable suspicion necessary to justify the stop.
