The Supreme Court affirmed Defendant’s convictions of two counts of criminal endangerment, one count of driving under the influence of alcohol, and one count of open container violation, holding that the district court did not err in refusing to give Defendant’s proposed jury instruction.During trial, Defendant proposed jury instructions on the lesser included offense of negligent endangerment. The district court declined to give the proposed instruction, concluding that the evidence did not support a finding that Defendant did not act knowingly.
